Some platforms or partners we use or link to from the Sites may collect data for their own purposes as controller or joint controller. Those platforms or partners will provide their own privacy policy, which will apply to their collection and use of data collected for their own or joint purposes. We do our best to partner with companies we trust to responsibly handle data about you, but please have a look at these other privacy policies so you understand how those partners will use your data.

For individuals in the European Economic Area or United Kingdom, our legal bases of processing are:

  • Consent for direct marketing such as sending you emails, for analytics and advertising cookies, for sharing your actions on our Sites with advertising partners to measure our ads, and for usage data from our Software. If you do not consent, we do not use advertising cookies or share these actions with advertising partners.
  • Necessary for performance of a contract for fulfilling merch purchases or other orders, and for providing the Software and the subscriptions you purchase, including sign-in, subscription verification, update checks, and the AI assistants.
  • Necessary for compliance with legal obligations where the data processing is required by law.
  • Legitimate interest for other uses, such as crash reports that help us fix defects in the Software.

How we share information about you

We may share information about you in the following ways:

  • With vendors who provide services on our behalf. These vendors will only use data about you for the purpose of providing services and not for their own benefit. For our Software, these include Google Analytics, which receives Software usage data when you allow it, and the AI model providers that process messages sent to our AI assistants.
  • With your consent or upon notice and opportunity to opt out, according to legal requirements.
  • In response to a legally enforceable subpoena, court order, government inquiry, or other binding legal process.
  • Where necessary to protect the rights, safety, or security of you or others.
  • With an acquiring company as part of a sale, merger, or similar transaction where our company or its assets are purchased.

We may engage in common data practices that are considered a "sale" or "sharing" of personal information, or "targeted advertising", under certain laws including the California Consumer Privacy Act. These include advertising cookies and pixels on our Sites and sending the actions described above (with hashed email addresses and other identifiers) to advertising platforms, currently Meta and OpenAI, to measure and improve our advertising. You can opt out at any time using the โ€œDo Not Sell or Share My Personal Informationโ€ or โ€œCookie settingsโ€ link at the bottom of our Sites, by choosing โ€œReject allโ€ in our cookie banner, or by turning on Global Privacy Control in your browser, which we treat as a valid opt-out request.

We do not sell or share your mobile phone number with third parties or affiliates for marketing purposes. However, your phone number may be transferred to a third party as part of a sale or merger of our company or assets.

We do not sell usage data from our Software or use it for targeted advertising. Each request that sends it to Google Analytics marks it as not to be used for advertising or ad personalization.

Your rights

You may have the right to control how we collect, use, or share information about you, including rights to access, correct, delete, obtain copies of, withdraw consent for, or opt out of online advertising or other processing of data about you.

To exercise these rights, please contact us as described in the โ€œHow to contact usโ€ section above. We will respond as quickly as we can within the time periods required by applicable laws, which in most cases is between 30 and 45 days.

Storage and retention of data

Our default rule is that we keep information about you as long as it is needed for the purpose it was collected or for a use disclosed above. We will use reasonable security measures to protect your data.

Usage data from our Software is kept in Google Analytics for up to 14 months and is then deleted automatically. Our Software also keeps some files on your computer, including your settings and usage-data choice, diagnostic logs (kept for about 7 days), crash reports, and a short queue of usage events that could not be sent yet. You can delete these files at any time from the Cryo Mix folder in your computerโ€™s application support directory.

We may use service providers that store data in different parts of the world, including the United States. We take steps to ensure our service providers comply with international data transfer requirements, usually through approved data transfer agreements.

Children

Our Sites are not directed to children. If you believe we have collected data about your child, please contact us and we will either delete that data or obtain your parental consent for its use.

Analytics, cookies, and tracking

We use cookies, pixels, and similar technologies on our Sites. Essential cookies keep the Sites working (for example, keeping you signed in and protecting forms) and are always on. The others fall into two groups, which you control in our cookie banner:

  • Analytics cookies: Google Analytics and Microsoft Clarity, which help us understand how the Sites are used. Microsoft Clarity may record how you interact with pages, such as clicks and scrolling.
  • Advertising cookies: the Meta Pixel and the OpenAI Ads pixel, which let Meta and OpenAI measure whether our ads lead to sign-ups and purchases. With the same choice, our servers also send the actions listed in the table above to Meta and OpenAI through their conversion services, with your email address and account ID in hashed form. Meta and OpenAI process this data under their own privacy policies. The same choice covers Tolt, which records which partner referred you so we can pay their referral commission.

How your choice works depends on where you are:

  • If you are in the European Economic Area, the United Kingdom, Switzerland, or we cannot tell where you are, analytics and advertising cookies stay off, and nothing is shared with advertising partners, until you choose โ€œAccept allโ€ or turn them on under โ€œCustomizeโ€. We decide this from the country of your internet connection.
  • Everywhere else, analytics and advertising cookies are on by default and our cookie banner tells you so. You can turn them off by choosing โ€œReject allโ€ or under โ€œCustomizeโ€. If your browser sends a Global Privacy Control signal, we treat it as an opt-out and keep them off unless you turn them on yourself.
  • You can change your choice at any time from the โ€œCookie settingsโ€ link at the bottom of our Sites. When you turn advertising off, we stop the pixels on the page and stop sharing your actions with advertising partners from then on.

Some of the ads you see may be personalized, meaning the advertising partner uses information it has about you to show ads it expects to be relevant.

Usage data in our plugins and installer

Our Software can send usage data to Google Analytics so we can understand how the Software is used and make it better. The data collected is listed in the table above. It never includes your audio, your files, the names of your files or projects, the text of anything you type, or your email address or name. If you are signed in, it is linked to your account only by its numeric ID.

  • If you are in the European Economic Area, the United Kingdom, Switzerland, or another place where the law requires your consent first, nothing is sent until you choose โ€œAllowโ€. We decide this from your computerโ€™s region and time zone settings, and if we cannot tell, we ask.
  • Everywhere else, usage data is shared by default, we tell you when you first use the Software, and you can turn it off at any time.
  • Your choice applies to the companion installer and every Cryo Mix plugin on that computer. You can change it at any time in the installerโ€™s Settings (โ€œShare anonymous usage dataโ€) or in the account menu of any plugin (โ€œShare usage dataโ€).
  • When you turn it off, the Software stops sending usage data, discards anything not yet sent, and deletes the random identifier stored on your computer. If you turn it on again later, a new identifier is created that is not linked to the old one.
  • To ask us to delete usage data already sent, contact us as described in the โ€œHow to contact usโ€ section above.

Separately from usage data, the Software connects to our servers to sign you in, verify your subscription, check for updates, send crash reports, and power the AI assistants, as described in the table above. These connections are needed for the Software to work and are not affected by the usage-data setting.

Changes to this privacy policy

Any material changes we make to our privacy policy in the future will be posted here. We will also notify you of privacy policy changes through email, login notifications, or other mechanisms reasonably designed to provide notice of the changes. We encourage you to check our privacy policy periodically to refresh your understanding of our data practices.

EEA, UK, and Swiss disclosures

We do not process your personal data for automated decision-making.

Our processing of your personal data may require transfer of your personal data outside of the European Economic Area and United Kingdom. In these cases we will take steps to apply approved safeguards, usually through approved data transfer agreements.

In some cases you may have the right to request a copy of these safeguards, which you can do by contacting us as described in the "How to contact us" section above.
